This book presents an overview of these studies and attempts to clarify apparently disparate results by placing them in a coherent theoretical framework.

Courts have broadly interpreted the Airline Deregulation Act to preempt most state attempts to regulate air ambulance billing abuses, so a federal solution is ultimately needed. Many Aboriginal people (...) find hospitals unwelcoming and are reluctant to attend for diagnosis and treatment, particularly with few Aboriginal health professionals employed on these facilities. In this paper, scientific literature and reports on Aboriginal health‐care, methodology and cross‐cultural education are reviewed to inform a collaborative model of hospital‐based organisational change. The paper proposes a collaborative model of care to improve health service delivery by building capacity in Aboriginal and non‐Aboriginal personnel by recruiting more Aboriginal health professionals, increasing knowledge and skills to establish good relationships between non‐Aboriginal care providers and Aboriginal patients and their families, delivering quality care that is respectful of culture and improving Aboriginal health outcomes. A key element of model design, implementation and evaluation is critical reflection on barriers and facilitators to providing respectful and culturally safe quality care at systemic, interpersonal and patient/family‐centred levels. A dual-audience signaling problem framework provides a deeper understanding of the perpetuation of group-based inequality. We describe a model of underachievement among minority youth that posits a necessary trade-off between academic success and peer social support that creates a dilemma not typically encountered by nonminorities. Preliminary evidence consistent with the approach is discussed. Such strategic agent perspectives complement the psychological approach put forth by Dixon et al., but with minimal ancillary assumptions.

Exploratory research was undertaken in four locations in the Asia Pacific Rim to investigate the cognitive frameworks used by managers when considering ethical business dilemmas. In addition to culture, gender and organisational dimensions were also studied. Aggregate analysis revealed no significant differences in the cognitive frameworks used by business managers in Hong Kong, Malaysia, New Zealand, and Canada. Of the eight frameworks used in the study four cognitive frameworks appeared to feature predominantly. Utilising the results of regression analysis the most (...) salient cognitive frameworks utilised by managers were identified as; Self Interest, Neutralisation, Justice and Categorial Imperative, with Neutralisation and Self Interest being the most significant among all managers. Religious Conviction and the Light of Day framework (which relates to fear of being exposed) did not feature prominently in the analysis. A few significant differences in the ethical frameworks used by males and females were identified. For males in all four locations Self Interest, Neutralisation and Justice appeared to be dominant frameworks, while considerable variability was seen in the frameworks used by females. Marginally significant differences were observed in the cognitive frameworks used by managers with differing functional responsibilities. Across all locations respondents with general management responsibilities relied predominately on Self Interest, while those with marketing responsibilities utilised Neutralisation. Respondents with an accounting orientation also relied predominately on Neutralisation and Categorial Imperative frameworks. (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. We apply an online optimization process based on machine learning to the production of Bose-Einstein condensates. BEC is typically created with an exponential evaporation ramp that is optimal for ergodic dynamics with two-body s-wave interactions and no other loss rates, but likely sub-optimal for real experiments. Through repeated machine-controlled scientific experimentation and observations our ’learner’ discovers an optimal evaporation ramp for BEC production. In contrast to previous work, our learner uses a Gaussian process to develop a statistical model of the (...) relationship between the parameters it controls and the quality of the BEC produced. We demonstrate that the Gaussian process machine learner is able to discover a ramp that produces high quality BECs in 10 times fewer iterations than a previously used online optimization technique. Furthermore, we show the internal model developed can be used to determine which parameters are essential in BEC creation and which are unimportant, providing insight into the optimization process of the system. BackgroundWith the enactment of Bill C-7 in Canada in March 2021, people who are eligible for medical assistance in dying (MAiD), whose death is reasonably foreseeable and are at risk of losing decision-making capacity, may enter into a written agreement with their healthcare provider to waive the final consent requirement at the time of provision. This study explored healthcare providers’ perspectives on honouring eligible patients’ request for MAiD in the absence of a contemporaneous consent following their loss of decision-making capacity. MethodA critical qualitative methodology, using a feminist ethics theoretical lens with its focus on power and relationality, was used to examine how socio-political and environmental contexts influenced healthcare providers' moral agency and perspectives. Semi-structured interviews were conducted with 30 healthcare providers (13 physicians, six nurse practitioners, nine nurses and two social workers) from across Canada who provide MAiD-related care.ResultsThemes identified include; (1) balancing personal values and professional responsibilities, (2) anticipating strengths and limitations of the proposed waiver of final consent amendment, (3) experiencing ethical influences on decisions to enter into written agreements with eligible patients, (4) recognizing barriers to the enactment of MAiD in the absence of a contemporaneous consent and (5) navigating the potential for increased risks and burden.DiscussionTo our knowledge, this is the first study in Canada to explore healthcare providers’ perspectives on waiving the final consent for MAiD using a written agreement. Most participants supported expanding eligible people’s access to MAiD following loss of capacity, as they believed it would improve the patients’ comfort and minimize suffering. However, the lack of patients’ input at the time of provision and related ethical and legal challenges may impact healthcare providers’ moral agency and reduce some patients’ access to MAiD. Providers indicated they would enter into written agreements to waive final consent for MAiD on a case-by-case basis. This study highlights the importance of organizational, legal and professional support, adequate resources, clear policies and guidelines for the safety and wellbeing of healthcare providers and to ensure equitable access to MAiD. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. BACKGROUND: Hallucinations and delusions that complicate Parkinson’s disease could lead to nursing home placement and are linked to increased mortality. Cognitive impairments are typically associated with the presence of hallucinations but there are no data regarding whether such a relationship exists with delusions. OBJECTIVE: We hypothesized that hallucinations would be associated with executive and visuospatial disturbance. An exploratory examination of cognitive correlates of delusions was also completed to address the question of whether they differ from hallucinations. METHODS: 144 PD subjects (...) completed a neuropsychological battery to assess cognition and the SAPS to examine psychosis. Correlational analyses assessed associations between hallucinations and delusions with cognitive domains. RESULTS: 48 subjects reported psychotic symptoms: 25 experienced hallucinations without delusions, 23 had symptoms dominated by delusions. Severity and/or number of hallucination subtypes were significantly correlated with lower scores in language, memory, attention, executive functioning, and visuospatial ability. Correlations with delusions were non-significant. Tests of differences in the size of the correlations between groups revealed a significant relationship between language and visuospatial performance with hallucinations. CONCLUSIONS: Cognitive correlates of hallucinations and delusions appear to be different in PD, suggesting distinct pathogenic mechanisms and possibly anatomical substrates. Hence, delusions may not share the same associations with dementia as hallucinations. Since this is a new finding, further studies will be needed to confirm our results. (shrink)

Arbery; 255 pp. Wilmington, Delaware: ISI Books, 2001, $24.95. Over the last decade or so, there has appeared an increasing number of books critical of the profession of literary studies. Such criticism has typically been directed (...) at literary theory and its preoccupation with the politics of race, class, and gender. To a limited extent, Glenn Arbery's Why Literature Matters: Permanence and the Politics of Reputation can be classified as belonging to such a "genre." Early in the book, for example, Arbery argues in favor of the "old-fashioned" idea, as he calls it, that literature is a "mode of knowledge" with the potential to open up transcendent modes of experience. Yet Why Literature Matters is so short on polemics and so long on incisive, sometimes brilliant readings of works ranging from the poetry and fiction of Seamus Heaney, Tom Wolfe, Toni Morrison, and Emily Dickinson to Shakespeare's Othello and Homer's Iliad, that such a characterization is insufficient at best and distorting at worst. Notwithstanding its title, this book is devoted less to advancing a polemic about "why literature matters" than to dramatizing, with performative power and grace, why most of us, politically oriented or not, are already quite sure that it does.Such performative power can be felt throughout Why Literature Matters, but [End Page 373] its presence is especially strong in the final, lengthy chapter on the Iliad, "The Sacrifice of Achilles." Bringing to bear his training as a classical scholar, Arbery contends that the Iliad is "about" a single event: the death or "sacrifice" of Achilles. Achilles, Arbery notes, was not just the greatest hero of the Iliad. He was also the greatest hero of the entire classical world: "Achilles has no rival in glory, either in the generation of heroes before him (not even Herakles), or in the ages after him. According to Plutarch, Julius Caesar wept because he had not accomplished as much as Alexander at the same age, but Alexander the Great envied Achilles."Why, then, does Arbery refer to Achilles' death as "sacrificial"? Drawing on a version of the Greek myth whose source is Pindar rather than the more commonly cited Hesiod, Arbery observes that Achilles' sacrificial death, which is not in fact narrated in the Iliad but is everywhere taken for granted, was necessitated by Zeus' successful plan to forestall a prophecy. That prophecy said that a son would be born to Zeus and the goddess Thetis, who would overthrow the Olympian god as Zeus had overthrown the Titans. During his lifetime, F.C.S. Schiller was viewed as a major figure in the pragmatist movement, but his reputation has faded. This article will challenge the view that he was an unoriginal or less important figure. In particular, I will attempt a reconstruction of Schiller’s position on first philosophy, which will examine the differences between Schiller and the other major figures in the pragmatist movement. By using texts from Schiller’s writings, I attempt to create an undistorted reconstruction of what he wrote (...) in order to support this interpretation. I outline the implicit system contained in Schiller’s scattered writings and briefly examine the relation between Schiller’s humanism and other forms of pragmatism. The task seems both justified and worthwhile, since his work has been neglected, despite his prominence in the debates over pragmatism that took place when it emerged at the beginning of the twentieth century. R.C. Pradhan claims in Language, Reality, and Transcendence that, in Ludwig Wittgenstein’s Tractatus Logico-Philosophicus and Philosophical Investigations, “[i]n no case is Wittgenstein interested in the empirical facts regarding language, as for him philosophy does not undertake any scientific study of language” (Pradhan 2009, xiv). I consider Ludwig Wittgenstein’s purportedly anti-scientific and anti-empirical approach to language in light of advances by philosophers and linguists in the latter half of the 20th century. I distinguish between various ways of understanding Wittgenstein’s stance against (...) scientism. Due to the success of more recent work on language, I argue that Wittgenstein’s critique, as interpreted by Pradhan in Language, Reality, and Transcendence, does not undermine the formal study of language. Nevertheless, I argue, the contention of Wittgenstein and Pradhan that language, through grammar (in Wittgenstein’s sense), serves a variety of functions still sheds light on the differences in meaning across different discourses. I argue that a synthesis of Wittgenstein’s pluralist theory of meaning with elements of a theoretical study of language offers the best comprehensive account of natural language. I will argue that this conception of language is consistent with elements of Pradhan’s interpretation. As Pradhan notes, “The aim here is not to project one kind of grammatical determination but keep options open for many such grammatical determinations such that the grammatical nuances are not papered over in the name of the unity of grammar” (Pradhan 2009, 28). There are words. There are sentences. There are languages. Commonsense linguistic realism is the conjunction of the three preceding claims. Linguists and philosophers including Noam Chomsky (1986, 2000), Georges Rey (2006, 2008), and Barry C. Smith (2006) have presented skeptical doubts regarding the existence of linguistic entities. These doubts provide no good reason to deny commonsense linguistic realism. Some skeptical doubts are in fact not directed at the metaphysical thesis of commonsense linguistic realism but rather only at non-metaphysical methodological concerns. (...) In some instances, linguistic antirealists make their case by foisting upon the realist assumptions that she need not hold regarding the nature of linguistic entities. Furthermore, those who have denied the existence of linguistic entities have not themselves presented an alternative account of words, sentences, or languages that is coherentor defensible. I present an elaboration and defense of commonsense linguistic realism as a metaphysical thesis, with the aim of deflating concerns that have arisen about the existence of language. (shrink)
